One concern for attorneys, especially attorney bloggers, is how much you can write about existing cases. Obviously, I cannot list my client names or violate the attorney client privilege. But, I can write about things that happen in cases.
I have a half dozen or so cases with Erica Brachfeld. I called on Friday to her office at Brachfeld and Associates. I asked for her, but alas, she was not in - again. Interestingly, she has never been in when I have called. But I spoke to a collector.
I asked the collector where my money was from the three sanctions awards I have against them. He said he did not know but would take a message. I asked when I could expect my money. He said "Good luck with collecting from us." Really? Good luck?
Am I the only one who finds it ironic that a debt collector, or in this case, a debt collection attorney, does not pay its own bills? Ms. Brachfeld takes an aggressive approach in trying to collect money from people, whether it is owed or not, but she will not pay court ordered awards.

Jonathan - you should HEAR the things the collectors tell our elderly clients. I also have attempted to talk directly with Erica and was to to "suck it up" by one of her bill collector paralegals as well as "stop trying to weasel out of the debt your client owes.". I have thought of reporting her to the State Bar, have you? This is why lawyers have a bad name.

Yesterday, I sent the following e-mail to Erica Brachfeld at Brachfeld & Associates:
Dear Ms. Brachfeld,
I have over the course of the last two weeks received three phone calls from the so-called "Brachfeld law offices." You are, apparently, a debt collection agency asking for someone who does not live at this address (xxxx xxxx xxxx, xx, xxxxx) and has not lived at this address for more than 25 years.
There was a call last evening (10.08 pm EST) from a "Mr. Jerome." He was told that no one of the name he cited lives at this address. He was also told that this was the second call and that no further calls would be tolerated.
Today, I found another call on my answering machine from this "Mr. Jerome." I have returned his phone call and told him, in no uncertain terms, that I am lodging a complaint with both the FTC and with my State Attorney-General. Since it would appear that English is his second language, I am communicating the same information to you.
I will also be contacting the State bar authorities in Texas and California if any more phone calls are received from the so-called "Brachfeld law offices."
